DMCA Notices Added to Various Modules in RCO3®

In conjunction with the Digital Millennium Copyright Act (DMCA) providing a mechanism for online service providers (like Realcomp) to handle allegations of copyright infringement regarding content submitted by subscribers, Realcomp has implemented several new on-screen notices in the RCO3® MLS system. These new notices appear throughout the system in various places, including:

  • At the end of the listing entry process;
  • At the end of the photo, virtual tour, and other media upload process;
  • As a footer on the RCO3® homepage; and 
  • As a disclaimer in the Client Portal.

The notices serve several purposes, including:

  • To inform/remind MLS subscribers that they must have full rights, power, and authority to the digital media before submitting it to Realcomp;
  • To grant to Realcomp an assignable, irrevocable, perpetual, worldwide, non-exclusive license for the digital media as it relates to providing agreed-upon services including, without limitation, the republishing of the content in whole or in part and in any format;
  • To inform MLS subscribers and all other users that the DMCA provides a mechanism for Realcomp to handle allegations of copyright infringement regarding content submitted by subscribers;
  • To inform MLS subscribers and all other users that Realcomp’s policy is to expeditiously respond to notices of alleged copyright infringement that comply with the DMCA; and
  • To link to the U.S. Copyright Office Website at http://www.copyright.gov for more information about the DMCA.

In a nutshell, these new notices will help Realcomp to better serve you when it comes to protecting and enforcing copyrights of digital materials submitted to the Realcomp.
