DMCA Policy
Realcomp offers a service which allows subscribers to post, display, publish, distribute or otherwise submit material to RealcompOnline, including but not limited to information about real property for sale or rent.
The Digital Millennium Copyright Act (“DMCA”) provides a mechanism for online service providers such as Realcomp to handle allegations of copyright infringement regarding content submitted by subscribers. It is Realcomp’s policy to expeditiously respond to notices of alleged copyright infringement that comply with the DMCA, the text of which can be found at the U.S. Copyright Office Website, http://www.copyright.gov.
Copyright Claimants
If you believe that your intellectual property rights have been violated by Realcomp or by a third party who has submitted content to our site, please provide the following information to the Realcomp-designated agent listed below:

A description of the copyrighted work or other intellectual property that you claim has been infringed;

A description of where the material that you claim is infringing is located on our site;

An address, telephone number and an email address where we can contact you;

A statement that you have a good faith belief that the use is not authorized by the copyright or other intellectual property rights owner, by its agent, or by law;

A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner’s behalf; and
-
Your electronic or physical signature.

Upon receipt of a notice complying with the above requirements, Realcomp will disable access to the allegedly infringing content, and notify the subscriber who submitted it. However, if the subscriber sends a counter-notice complying with requirements set by the DMCA as described below, Realcomp will restore access to the content in ten to fourteen days unless you file a lawsuit seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system or network.
Replacement of Removed Content
If your content has been removed from our site and you have received notification from Realcomp that another party has alleged that your post infringes on his intellectual property rights, you may object by sending a counter-notice to our designated agent. The counter-notice must contain:

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it disabled;

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;

An address, telephone number and an email address where we can contact you;

A statement that you consent to the jurisdiction of the Federal District Court in which your address is located, or if your address is outside the United States, for any judicial district in which Realcomp does business, and that you will accept service of process from the person who provided notification of the allegedly infringing material; and

Your electronic or physical signature.

If Realcomp receives a counter-notice complying with the above-listed requirements of the DMCA, Realcomp will notify the person who provided the original infringement notification and provide a copy of the counter-notice, and Realcomp will replace the removed material in ten to fourteen business days, unless our designated agent receives notice that a lawsuit has been filed seeking to restrain you from engaging in infringing activity relating to the material on our system or network.
Repeat Infringers
In accordance with Section 512(i)(1)(A) of the DMCA, Realcomp will, in appropriate circumstances, disable and/or terminate the accounts of contributors who are repeat infringers.
