Realcomp’s “Do Not Show/Publish” Policy Adjusted for Auction Listings

During the last two (2) months, your Realcomp Board of Governors has revisited Realcomp’s MLS policy that states: “All listings in the MLS must be available to show”.

This policy was originally adopted by Realcomp’s Board in August, 2014 in response to the growing number of listings being entered into the MLS, but being blocked from showings by MLS Subscribers. Upon implementation of this new stipulation, Realcomp received wide support from MLS Subscribers for it. However, the policy impacted the ability of MLS subscribers to effectively list and sell auction properties. As you may know, auction properties are very often not legally accessible by the owner/seller. In these instances, showings CANNOT be facilitated for these properties. So, your Realcomp Board of Governors approved the following exception to Realcomp’s “do not show” MLS policy:

To allow auction listings where the seller does not have access to the property and, therefore, does not allow access to the property, to be exempt from the “no show policy”. Further, these properties can be included in the MLS.

An affidavit or a copy of the listing agreement stating that the seller does not have access to the property, signed by the seller, must be submitted to the MLS at the time the property is entered.

Additionally, both the agent and public remarks of this type of listing must state:

"The seller does not have access to the property. The property is occupied and the occupants are not to be disturbed or contacted under any circumstances. Interior inspections are not available and property is being sold as is. Please do not trespass."
